In this case, the thesis argues that medical malpractice lawsuits should not be capped as the medical community would like to see.  In the introduction, the student will focus on outlining the thesis and then presenting methods as to how he/she will support the statement. In  this case, weve taken a look at the literature to determine what both proponents and opponents of caps are saying. There also  needs to be a statement of purpose for the paper - in this case, the student can discuss the rise in healthcare costs and the apparent rise in medical malpractice  insurance premiums. 2) In Support of Caps In order to support both views for the above pieces, the student needs to  present both sides. Without presentation of both sides, the paper is not a good essay or argumentative one. In this section, the student will attempt to present ideas that  support the use of caps on lawsuits. As can be expected, the medical community is in support of such caps. A) Skyrocketing Insurance Rates One reason  used quite frequently by supporters of caps are that todays medical liability has meant skyrocketing rates for medical malpractice insurance (Hillman 49; see also Groch 52). One such article arguing  the case for caps points to Californias Medical Injury Compensation Reform Act, which has been lauded as an ideal model for limiting liability claim filings and settlements for malpractice cases  (Hillman 49).
