    owns Morts A1 Funeral Home, located in Cottonball, California. In the course pf his duty he was contacted by Mr Richey, with reference the arrangements for his wife, Celia  Richeys funeral. Mort agreed to take the body immediately and the relevant papers were signed by Mr Richey. Two days after this Mr Richey cam into the funeral home to  make the relevant arrangements, the discussion became heated, with Mr Richey accusing Mort of trying to take advantage of an old man. During this Mort also lost his temper and  used bad language to Mr Richey. Mr Richey left, and sent a different funeral director, with the relevant paperwork, to A1 the following day, as he wished to move his  wifes remains. Mort informed the new funeral director; Ms Bowers, that he would need to sort out his own paperwork before he could transfer the custody of the body. The  transfer did not take place for three day. During this time Mort says his secretary was ill, and he was unable to complete the paperwork, and undertook the transfer at  the first opportunity. It appears that Mr Richey made several telephone calls at this time to Mort, who states he was able to remain calm. After three days the body  was transferred. Now work had taken place on the body apart from the storage. Now, after taking advice from his nephew, Seymour (a first year law student), he believes he  has a case to bring against Mort for intentional infliction of emotional distress. In evidence to the effect this has had on  him, Mr Richey states that he is now on medication to sedate him and is having difficulty sleeping and believes he will end up needing psychiatric help.
