In  the United States the Department of Commerce International Trade Commission is the main body that will assertion in dumping has taken place (ITA, 2003). Domestic cases, where it is  a company within the US that claims to be suffering as a result of dumping is referred to the International Trade Commission, which will take into consideration all the relevant  economic facts, not only prices, but also the domestic situation of the products such as employment levels, profits and market share (ITA, 2003). The investigation, if found positive, and the  Department of Commerce agree will make an instruction to the Customs service to make an assessment of duties on the relevant imports that are being dumped (ITA, 2003). The  duty levied will reflect the dumping margin, so of goods are at 40% below their fair price the duty will be 40% (ITA, 2003). Petitions may be foiled by companies  within the US that feel they are suffering due to dumping, help from the department is available for the smaller companies. An example of the use of anti-dumping legislation is  seen with the import of seafood. The US Department of Commerce ruled in preliminary findings that Vietnam was dumping cheap catfish onto the US market (Rajkumar, 2003). The result has  been the imposition of duties up to 64% on the imports (Rajkumar, 2003). There is currently an investigation into 16 different shrimp producing nations as well, with low prices seen  to hurt the US industry as a result of the price drop of 29% over the last three years (Rajkumar, 2003).
