A twenty page paper which considers the relationship between local authorities and British courts with regard to child welfare cases. The writer looks at the way in which cases are assessed and evidence presented, how the court’s view of the child’s welfare may conflict with that of the authority, and to what extent the courts are at liberty to extend or amend the authority’s proposals. The writer also explains the impact of the Human Rights Act 1998 on the UK judicial system and shows how the articles of the European Convention must be taken into account by domestic courts in child welfare cases.
