    impacting on commerce. In this paper we will consider impact of the Landlord and Tenant (Covenants) Act 1995. It may be argued that this is one of the most fundamental  shake ups of the landlord and tenant relationship to take place, with many areas of the Act being seen as controversial in the way that it changes rights and duties,  also in the way that in certain circumstances it will also apply to leases that were in existence prior to the legislation coming into force, which occurred in January 1996  (Wallace and Shaw, 1996). It is also argued that whilst the aims of this law were to bring the landlord and tenant relationship up to date with modern commercial needs,  that this change may be seen as having both advantages and disadvantages for the landlords and tenants concerned (Wallace and Shaw, 1996).  We also current have a scenario where there is a complex dual situation due to the way in which there are now two different sets of rules.. There are leases  that are covered by this; all those the leases that were initiated after the date of the legislation, and those that are not covered by this legislation, which may or  may not be covered by this act, depending on the way in which the lease has commenced (Wallace and Shaw, 1996). One of  the major changes in this Act was the way in which privity to the contract was changed. Privity of contract is the relationship that occurs between the contracting parties (Ivamy,  2000). This is seen by the way the new Act had the effect of abolishing privity of contract for new leases. However,
