    would see that the courts have been the main enabling instrument allowing profiling to take hold. It is they who can dictate just how far a police officer can go  in their interrogation of someone while they are on the job. To win a racial profiling case, it would seem that the evidence would have to be blatant. Everywhere there  are more and more cases of racial profiling being tried and it would seem according to research that more often than not the courts are not ruling in favor of  the plaintiff. Because of its susceptibility to abuse, racial profiling by todays law enforcement agencies should not be allowed as a means for arresting or investigating people.  Just the term discrimination has had an evolution. The term in the early 1930s was uncommon, but in the next decade would take on  a whole new meaning as the plight of the black neighborhood came to light. Now, discrimination encompasses so much, but when all the political rhetoric is boiled away, as it  well might be very soon, the average citizen knows that discrimination is the treatment of equals as if they were not just as equal. Discrimination doesnt have to have a  voice, it can be present in attitude, or behavior and no matter its vehicle, it is painful to those on the receiving end.  In New Jersey, a racial-profiling case succeeded after the release of state police internal memos that detailed the practice for officers. In Maryland, documentation showing that police staking out  Interstate 95 used written directives to pull over motorists from a particular African-American neighborhood led to victory for one black defendant(Christian Science Monitor 2003). These two cases, among many others,
