    second is the contract of the sale of a property form Owner to farmer. The two matters are related as the farmer needed the property he was purchasing in order  to grow the wheat to sell to buyer. The issues here are to consider the position of by buyer and the position of  farmer regarding the purchase of the farm. The facts are as follows. There was an agreement that Farmer would grow wheat for Buyer, the price was to be fixed as  a rate that related to the commodity market. However as a term of the agreement also stated that should this price be more than 10% higher than the rate on  the commodity exchange in July of the pervious year, then there would be an option for buy to withdraw form the deal, as long as Buy gave written notice of  one day, that he did not wish to purchase the wheat. The agreement was written on the standard form of Farmer, and  the agreement was that the wheat was to be grown on a farm near the town. At this time there was not a farm owner by farmer in this area,  but Farmer intended to buy one. This was known to Buyer. In the attempt to purchase a farm Farmer offered owner $200,000  for a farm that would meet with the requirements of the above agreement; near town. This offer was rejected with Owner stating that he would not sell for less than  $250,000. Farmer then sends what he deems to be an acceptance to the offer of $250,000. In this he says he accepts the offer, but asks to make two separate
