Part I Summary The conflict between how criminals  are treated in terms of search and seizure and the gathering of evidence in criminal investigations has long been debated. Often the debate hinges on an argument between the crime  control model and the due process model. The crime control model specifies that victims rights should be protected and the police should do everything in their power to ensure that  "known" criminals are incarcerated. The due process model guarantees the rights of suspected criminals under Fourteenth Amendment protections. The Fourteenth Amendment contains  a number of protections, one of which is protection against unlawful search and seizure. Today, the exclusionary rule allows for searches to take place without a warrant in many cases.  This has given rise to the question of whether there are too many exceptions or if the exceptions are over-broad in scope.  Although the protection of citizens is of utmost concern, a recent Supreme Court supports a possible move away from the crime control model toward a more balanced use of the
