Concepts such as whole language reading have gotten a bad name, and while individual education plans have been all the rage,  not everyone agrees with testing children for disabilities. Others contend that while to some extent there may be an over-diagnosis of certain disorders, it is important to test children early  and often. If they do have a disability, test results may demonstrate that a child needs additional help. Still, much of the problem with testing and accepting test results as  valid has to do with the Americans with Disabilities Act (ADA). While it may appear quite simple, the ADA is actually the most complex and comprehensive employment law which has  come into being in the past twenty years ("USA," 1995). The law restricts an employers right to question job applicants about physical and mental functioning (1995). The mood  when this law was signed on July 26, 1990 was inspirational as about 3,000 Americans were on the White House lawn when President George Bush signed the historic document (Brower,  1998). It was historic. It was the first-ever civil rights law for those with disabilities (1998). While the law pertains a great deal to work situations, it also affects special  education. What it had done is to change, from a legal perspective, the notion of what a learning disabilities is. In the text of both civil rights legislation and special  education legislation, learning disabilities had reached disability status (Tomlan, 1996). In fact, in the interpretation of the Americans with Disabilities Act, examples of appropriate accommodations are for individuals with learning  disabilities and have been used to illustrate key concepts (1996). The ADA is important to a discussion on learning disabilities, as many critics believe that learning disabilities are over-diagnosed. Some
